1. These are our terms & conditions which apply whenever you access our website at www.cherrbrookvillage.com.au/neighbourhood-net. As a user of the Site and if you elect to become a member of the Site, you accept and agree with these terms and conditions (“Terms”) including our Privacy Policy (“Policies”)
You agree to these Terms by:
(a) clicking to agree to the Terms, where this option is made available to you on the Site; or
(b) using the Site. In this case, you acknowledge and agree to be legally bound by the Terms as of the date of your first use of the Site.
2. Mirvac Group reserves the right to change these Terms at any time at its discretion and without notice. Each time you use the Site you confirm your agreement to be bound by and acknowledge any changes to these Terms. It is your responsibility to review these Terms and our Policies from time to time for any amendments.
3. You agree to use the Site only for purposes permitted by the Terms and any applicable governing laws. Without limiting the foregoing you must not attempt to change, add to, remove, deface, hack or otherwise interfere with the Site. You may download and view content or print a copy of material on the Site for personal, non-commercial use provided you do not modify the content in any way (including any copyright notice). Unless expressly stated otherwise, you are not permitted to copy, or republish anything you find on the Site.
4. We reserve the right to alter, suspend or discontinue any aspect of the Site provided at any time.
5. If you wish to post any notice on the Site, you must create your own notice which you can do by following the appropriate prompts. Once you have submitted your notice, it will take two (2) working days to be approved by our Marketing Manager. Mirvac Group reserves the right, at its discretion, to reject your notice if it contains inappropriate or offensive material or information. Please ensure that you allow sufficient time for approval of your notice if it contains any dates.
6. When you submit content to Mirvac Group in any format, including any text, photographs, graphics, you warrant that that content is true and not defamatory and that you are not infringing any intellectual property rights or trade marks. You grant Mirvac Group a non-exclusive, royalty-free, perpetual license to publish that content whether in its original format or an amended format approved by Mirvac Group.
7. You may register your details with us to use the Site. Registration is free and does not oblige you to purchase anything. Membership of the Site is not transferable. Once you register as a member, you will be requested to provide us with a user name, password and an email address. Please refer to our Privacy Policy on your personal information that we may store for you.
8. Mirvac Group does not provide any warranties about the accuracy of the information contained on the Site. While Mirvac Group has made every effort to ensure that the information contained on the Site is free from error, Mirvac Group accepts no responsibility and will not be held liable for any errors or inaccuracies contained on the Site and makes no representation concerning the completeness, truth, accuracy or suitability for any particular purpose of the Site. Mirvac Group reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice to you.
9. All intellectual property in relation to content on the Site belongs to Mirvac Group or its licensors, advertisers or affiliates. You obtain no legal interest in that intellectual property. You acknowledge and agree that Mirvac Group owns all right, title and interest in and to the Site, including any intellectual property rights (including the entire Site, all images, logos, text, content, trademarks, copyright, URLs) found on the Site. You must not do anything which interferes with or breaches those laws or the intellectual property rights of Mirvac Group.
10. The Site may include links to third party sites which are not related to Mirvac Group and in relation to which Mirvac Group has no control or interest. The appearance of those links on the Site does not indicate any relationship between Mirvac Group and that third party or any endorsement by Mirvac Group of that third party, its site or the products or services which it is advertising on that site. Mirvac Group is not responsible for any loss or damage caused or suffered by you through accessing any third party sites.
11. You agree to comply with all laws, policies and regulations which are in any way applicable to your use of the Site. Without limiting the foregoing, you agree not to use the Site in any way which is fraudulent, misleading or otherwise unlawful or violates any law or use the Site in connection with any endeavours which may be illegal or unauthorised.

You indemnify Mirvac Group and its related entities, and each of their directors, officers, employees and agents against any action, claim, loss, expenses (including legal fees) or damages which it incurs or suffers, that arises from your use of the Site or as a result of a breach by you of any warranty contained in these Terms or Policies.
13. Mirvac Group may at any time, at its sole discretion, without notice to you temporarily suspend or terminate your access to the Site or your membership if:
(a) you have, or we believe you have, breached these Terms or any of our Policies;
(b) you are suspected or found to have engaged in inappropriate or fraudulent activity in connection with the use of the Site;
(c) Mirvac Group is unable to verify or authenticate any information you provide to it;
(d) Mirvac Group is required to do so by law; or
(e) Mirvac Group believes that your actions may result in legal liability.
14. The Terms & Policies set out herein shall be governed by and interpreted in accordance with the laws of the State of New South Wales.
Privacy Policy
The personal information Mirvac Group collects may include your name, address, phone number email address and any further information that you volunteer to us. We do not collect or store credit card details online. You agree that any personal information you provide to us is true and correct.
You authorise and consent that we may use your personal information that you provide for marketing and/or promotional purposes, to conduct surveys, to send you emails that contain information relating to the activities of the Mirvac Group and for use by any related entity of the Mirvac Group.
We will take reasonable steps to store your personal information such that unauthorised access, modification, disclosure, mususe and loss are prevented (such as by the use of password protection).

Buy/Sell Terms
Mirvac Group does not own, manufacture, offer for sale, sell or deliver any of the goods or services found on the Site. The Site merely acts as an online venue to allow a Seller to offer and sell their goods and services on the Site.
Before you are permitted to advertise any goods or services for sale on the Site, you must create you own advertisement which you can do by following the appropriate prompts. Once you have submitted your advertisement, it will take a few days before it is approved by our Marketing Manager. Once your advertisement has been approved, you will be notified in writing to the email address that you nominated when creating your advertisement.
Mirvac Group has the right, at its discretion, to reject your proposed advertisement if it contains inapproriate or offensive material or information.
Once an advertisement is approved for use on the Site, Mirvac Group is not otherwise involved in the transactions and interactions between the Seller and the Buyer.
All prices for advertised goods or services on the Site must be quoted in Australian Dollars. You acknowledge that the price for a Seller’s good or service may change at any time without notice to you. Such alterations become operative from the date they are published on the Site.
When you enter into a transaction with a Seller you create a legally binding contract with the Seller unless the transaction is prohibited by law or by these Terms. You canot commit to buying an item from the Site without paying the Seller. You are responsible for ensuring that you comply with your obligations to the Seller and you must ensure that you are aware of any laws relevant to you as a Buyer.
As a Seller, you warrant that you have free and unrestricted title to/ownership of the goods and that the goods are not subject to any lien, charge or hire-purchase arrangement. You must make the goods available for delivery to the Buyer and you must ensure that you are aware of all relevant laws that apply to you as a Seller. You must comply with your obligations once you enter into a transaction with the Buyer.
Mirvac Group does not accept any responsibility or any liability for any loss or damages suffered by any party arising out of, or in any way connected with, the transaction between the Seller and Buyer.
